VERVE Training App — Privacy Policy

This Privacy Policy explains how VERVE Fitness Equipment Pty Ltd ("VERVE", "we", "us") collects, uses, stores and discloses your information when you use the VERVE Training app for iPhone, iPad and Android (the "App"). By using the App, you agree to the practices described here.

1. Who we are

The App is provided by VERVE Fitness Equipment Pty Ltd, a company registered in Australia. We are the data controller responsible for your information. You can contact us using the details in section 14.

2. Information we collect

Information you give us

Health and fitness data (with your permission)

If you choose to connect the App to Apple Health (HealthKit) on iOS or Health Connect on Android, the App may read and write health and fitness data such as workouts, active energy, heart rate and body measurements. You control this access at any time in your device settings, and you can use the core App without granting it.

Information collected automatically

We do not use your health or fitness data for advertising, and we never sell your personal information.

3. How we use your information

4. AI-generated training programs

The App can generate personalised training programs. To do this, the information you provide for that purpose (such as your goals, experience level and available equipment) is sent securely to our program-generation service, which runs on Cloudflare infrastructure and uses the Anthropic (Claude) AI service to produce the program. This information is used only to generate your program and is processed under the providers' commercial terms, which do not use it to train their general AI models. Where possible the App can also generate a program on-device without sending this information externally.

We do not sell your personal information. We share it only in these limited cases:

6. Where your data is stored and processed

Your data is stored on your device and, where you have an account or use cloud features, on secure servers operated by us and our service providers. Some providers (including Cloudflare and Anthropic) may process data outside Australia, including in the United States. Where data is transferred overseas, we take reasonable steps to ensure it is handled consistently with this policy and the Australian Privacy Principles.

7. How long we keep it

We keep your information for as long as you use the App and your account is active, and as long as needed to provide the service, comply with our legal obligations, resolve disputes and enforce our agreements. When data is no longer needed, we delete or anonymise it. You can request deletion at any time (see section 9).

You can delete your account and associated personal data at any time by either:

On request we will delete the personal information we hold about you, except where we are required to keep certain records by law. We aim to action deletion requests within 30 days.

10. Security

We use reasonable technical and organisational measures, including encryption in transit, to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security, but we work to protect your data and to address any issues promptly.

11. Children

The App is not directed to children under 16, and we do not knowingly collect personal information from them. If you believe a child has provided us information, contact us and we will delete it.

12. Third-party services

The App relies on Apple, Google and the providers listed above. Your use of Apple Health, Health Connect, the App Store and Google Play is also governed by those companies' own privacy policies, which we encourage you to review.

13. Changes to this policy

We may update this policy from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, notify you in the App. Your continued use of the App after an update means you accept the revised policy.
